USER AGREEMENT
Welcome to The Magicians Library site. Your use of this site constitutes your agreement to abide by the following rules.
If you cannot agree with these rules, please do not continue using the Site.
Use of the Material by You
Magicians Library authorises you to view and use the material on
this Site solely for your personal, non-commercial use. The content
of this Site such as text, graphics, images, and other materials
("Materials"), are protected by copyright under both
England & Wales and foreign law. Unauthorised use of the
material may violate copyright, trademark, and other laws. You must
retain all copyright and other proprietary notices contained in the
original Materials and on any copies you make of the Material for
your personal use.
You may not sell or modify the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in any networked computer environment for any purpose is prohibited. If you violate the terms of this Agreement we reserve the right to terminate your access to the Site, and you must immediately destroy any copies you have made of the Material.
Links to other sites
As a convenience to you, we have provided links to other sites
where we feel it is appropriate. Our decision to link to third
party sites is not an endorsement of the content in the linked
site. We are not responsible for the content of linked third-party
sites, nor do we make any representations regarding the content or
accuracy of material on third party sites. If you decide to access
linked third-party sites, you do so at your own risk.
General
If you access the Materials outside the United Kingdom, you do so
at your own risk and are responsible for compliance with the laws
of your jurisdiction. This Agreement is governed by the internal
and substantive laws of England and Wales without regard to its
conflict of laws principles. No waiver of any term of this
Agreement shall be deemed a further or continuing waiver of such
terms or any other terms.
Lectures/Seminars
Tickets are non transferable nor are they redeemable for cash, ticket redemtion value will not exceed £00.00. In the event of the lecture being cancelled by the Magician's Library you wil be contacted at the earliest opportunity and given a full refund on the ticket price. If the purchaser cancels the Magician's Library will use its discretion whether to refund in part or full.
Contracts
This does not affect your statutory rights as a consumer.
Consumer Law
We agree to meet the obligations set out under the consumer
protection laws currently in force including:
• the Sale of Goods Act 1979;
• the supply of Goods and Services Act 1982;
• the Consumer Credit Act 1974;
• the Trade Descriptions Act 1968;
• the Unfair Contract Terms Act 1977 and the 1994
Regulations;
• the Consumer Protection Act. 1987; and
• the Consumer Protection (Distance Selling) Regulations
2000.
Severability
If any provision of this
Agreement is held by a court of competent jurisdiction to be
contrary to any law, the remaining provisions shall remain in full
force and effect as if said provision never existed provided that
the contract is capable of continuing in existence without the
unfair term.
Termination
The Magicians Library and the Service Provider possess the right to
terminate your ability to access the Site for any reason, without
notice.
Entire Agreement
All services provided to you by The Magicians Library are subject
to these terms together with any previous written or verbal
representations given or made by The Magicians Library or any
representatives of The Magicians Library. Thank you for taking the
time to review the terms and conditions of use for The Magicians
Library. We encourage you to periodically review these rules to
keep yourself apprised of any revisions to this Agreement. If you
do not agree to the terms contained in this Agreement, please exit
the Site. These terms and conditions do not affect your statutory
rights as a consumer.
Privacy Policy Statement
We at The Magicians Library are committed to protecting your
privacy. We will only use the information that we collect about you
lawfully (in accordance with the Data Protection Act 1998). We
collect information about you for 2 reasons: firstly, to process
your order and second, to provide you with the best possible
service. We will not e-mail you in the future unless you have given
us your consent.
The type of information we will collect about you includes:
• your name
• address
• phone number
• email address
• credit/debit card details
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law. We will not transfer your information outside the EEA (European Economic Area). We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. If you have any questions/comments about privacy, you should use our contact system.
We may use the information you have submitted to occasionally alert you regarding important changes to the The Magicians Library website.
When you order, we need to know your Name, e-mail address, delivery address, credit or debit card number and the card's expiry date. This allows us to process and fulfill your orders and to notify you of the status of your order. We may also ask for your telephone number which enables us or our contractor to contact you urgently if there is a problem with your order.
Please note that information we collect may be transferred
outside the European Economic area for the purposes of processing
and in order to maintain accounts.
Your Consent
By submitting information to The Magicians Library, you consent to
the collection and use of this information by The Magicians Library
and its Service Provider. If we decide to change our privacy
policy, we will post those changes on this page so that you are
aware of what information we collect, how we use it and under what
circumstances we disclose it.
Data Security
We have designed our site to protect the information we collect
online from unauthorised access. We safeguard your private
information by implementing the appropriate physical, electronic
and managerial procedures necessary to protect your privacy. You
can correct factual errors in your personal information on orders
or as a member of The Magicians Library by sending us a request
that shows the data's inaccuracy. To further protect your
security, we also take the reasonable steps to verify your identity
before granting access to your personal profile or making data
changes. We are committed to protecting your privacy and have
security measures in place to prevent unauthorised access to and
disclosure of your personal information.
Improving Our Service
The Magicians Library does not sell, trade or rent your personal
information to others. To better tailor our services to our
customers' needs, we use non-identifying and aggregate
information to help us make decisions on how to improve The
Magicians Library.

Whenever a website welcomes you and tailors data to your

Description of Goods
It is not practical to publish detailed specifications of all the
products. All images, descriptive matter, specifications and
advertising on our site are for the sole purpose of giving an
approximate description of the goods. Full detailed specifications
are available on request.
Payment and Price
The total price payable for the goods will be stipulated at the
time when you place your order whether or not the order has been
confirmed. We are entitled to make adjustments to the price to take
account of any increase in our supplier's prices, or the
imposition of any taxes or duties, or if due to an error or
omission the price published for the goods is wrong whether or not
the order has been confirmed. We will inform you of the correct
price and give you the opportunity to cancel the order. If we are
unable to contact you we will treat the order as cancelled. All
prices on our website are inclusive of VAT if applicable but
exclusive of delivery charges which will be payable as indicated at
the time of placing your order.
Typographical Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges).
Availability of Goods
All products and services are subject to availability and may be
withdrawn at any time. If we do not supply the goods for any reason
we will not charge you for these and we will refund any money
already paid for them. However, we will not be responsible for
compensating you for any other losses you may suffer if we do not
supply the goods.
Delivery
The Magicians Library always endeavours to adhere to delivery
estimates but they are unfortunately estimates and with the best
will in the world and the most efficient systems, things sometimes
do go wrong, very often outside of our control. Any dates we
specify for the delivery of the goods are approximate only and we
shall not be liable for any losses, costs, damages, charges, or
expenses caused by any delay for delivery of the goods and time is
not of the essence.
RETURNS POLICY FOR The Magicians Library
At The Magicians Library, we want you to be satisfied every time you shop with us. Occasionally however, we know that you may want to return items. To help you with this process please see our returns policy below.
Returning an item
You are responsible for ensuring the product is suitably packaged
for return. We will refund your credit/debit card once we have
received and processed the item (please allow up to 14 days).
Please note that we can only refund delivery costs if the return is
a result of our error.
Damage
In the unlikely event you should receive your goods damaged we will
attempt to arrange a replacement item for you. It is your
responsibility to notify us within 72 hours of receipt that an item
has been received damaged (please see risk below). To notify The
Magicians Library of any damage to your products (s) please use the
Contact Us page on the site.
Incorrect/ Non delivery
To notify us of any incorrect or non-delivery of product(s) please
use the Contact Us form on the site. If you receive incorrect goods
it is your responsibility to notify us within 72 hours of receipt
at which point we will make the necessary arrangements.
We can only accept liability for non-deliveries if we are notified within 3 days of the advised/anticipated delivery date.
Faulty
Upon delivery or within 28 days:
In the unlikely event that your goods are faulty on delivery, or
within 28 days of receipt, please contact us via the Contact Us
page. Please be aware you are responsible for ensuring the product
is suitably packaged for return.
Cancelling an item
You have the right to cancel your order at any time before a
confirmed delivery date free of charge.
You have the right to cancel your order within 7 working days after receiving your products without giving a reason providing the goods are in a resalable condition. The 7 working day cancellation period begins the day after receipt of those goods and you are required to notify us in writing within this time.
You are however responsible for the safe return of the product to us, including the cost of doing so. We will happily arrange this on your behalf and we will pass on the direct cost of doing so. Additional requirements or costs incurred, such as timed collections or overseas surcharges, for which there is additional cost to us, will be advised & passed on.
The cost of return varies by product and we will confirm the amount.
The above costs are a guideline only and a quotation for the exact cost is available upon request. Cost of collection will be deducted from the refund.
Under the Distance Selling Regulations we are obliged to action a refund within 30 days of written request being received. However as a customer focused organisation we set standards that far exceed our obligations. Accordingly our internal target to action a refund is 4 days, which we always endeavour to achieve.
If goods have been despatched and require return our target is to action the refund within 4 days of receipt at our returns centre or certainly within 30 days of the cancellation being requested, if that occurs sooner.
If you have decided to cancel your order or wish to return your products to The Magicians Library we will refund your credit card within 30 days of written cancellation being received.
This section has been introduced to incorporate the new European Directive on distance selling which is incorporated into UK law by The Consumer Protection (Distance Selling) Regulations 2000.
